Agreement to Terms

By accessing or using Hydro Hero ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Hydro Hero is a hydration tracking application available as a Chrome browser extension. The Service allows you to:

  • Track daily water intake
  • Set hydration goals and reminders
  • View hydration history and statistics
  • Earn achievements and maintain streaks
  • Sync data across devices (with an account)

  • The Service is intended for general wellness purposes only
  • Hydration recommendations are general guidelines, not personalized medical advice
  • The Service is not intended to diagnose, treat, cure, or prevent any disease
  • Always consult a qualified healthcare professional for personalized hydration and health recommendations
  • Do not disregard professional medical advice based on information from this Service

If you have any medical conditions or concerns about your hydration needs, please consult your doctor before using this Service.

User Accounts

Account Creation

  • You must be at least 13 years old (or 16 in the EU) to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

Account Security

  • Notify us immediately of any unauthorized access to your account
  • We are not liable for any loss arising from unauthorized use of your account

Subscription and Payment

Free Trial

New users receive a 7-day free trial with access to all features.

Premium Subscription

  • After the trial, continued access requires a paid subscription
  • Subscription options: $19.99/yr or $2.99/mo
  • Prices are displayed in the app before purchase

Billing

  • Subscriptions automatically renew unless cancelled
  • You authorize us to charge your payment method on a recurring basis
  • Payments are processed securely through Stripe
  • Failed payments may result in suspension of premium features

Cancellation

  • You may cancel your subscription at any time through the Settings page
  • Cancellation takes effect at the end of the current billing period
  • You retain access to premium features until your paid period ends
  • No refunds are provided for partial billing periods

Price Changes

  • We may change subscription prices with 30 days notice
  • Price changes do not affect current billing periods

User Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service
  • Reverse engineer or attempt to extract source code
  • Use automated systems to access the Service
  • Impersonate any person or entity

Intellectual Property

Our Content

The Service, including its original content, features, and functionality, is owned by Hydro Hero and is protected by copyright, trademark, and other intellectual property laws.

Your Data

You retain ownership of any data you input into the Service. By using the Service, you grant us a license to use this data solely to provide and improve the Service.

Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • The Service will meet your specific requirements
  • The results obtained from using the Service will be accurate
  • Any errors will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYDRO HERO SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, or goodwill
  • Any damages arising from your use of or inability to use the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Hydro Hero and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

Modifications to Service

We reserve the right to:

  • Modify or discontinue the Service at any time
  • Change features, functionality, or pricing with reasonable notice
  • Limit availability to any person, geographic area, or jurisdiction

Modifications to Terms

We may revise these Terms at any time. Changes will be effective when posted. Your continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of material changes via email or in-app notification.

Termination

By You

You may terminate your account at any time by deleting it through Settings > Delete Account.

By Us

We may terminate or suspend your access immediately, without prior notice, for:

  • Violation of these Terms
  • Conduct that we believe is harmful to other users or the Service
  • Any other reason at our sole discretion

Upon termination:

  • Your right to use the Service ceases immediately
  • All provisions that should survive termination will survive (including limitations of liability and indemnification)

Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law provisions.

Dispute Resolution

Informal Resolution

Before filing any claim, you agree to try to resolve the dispute informally by contacting us at support@hydroheroapp.com.

Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California.

Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hydro Hero regarding the Service.
